‘തന്ത്രിയെ പുറത്താക്കി ശബരിമല മലയരയർക്ക് തിരിച്ചു നൽകണം’: മുഖ്യമന്ത്രിക്ക് സംഘടിത പരാതി
ഭരണഘടനാ അവകാശങ്ങളെ നിഷേധിച്ചു എന്ന് ചൂണ്ടികാട്ടി ശബരിമല തന്ത്രിയെ തൽസ്ഥാനത്ത് നിന്ന് നീക്കണമെന്നും ശബരിമല ക്ഷേത്രം മലയരയർക്ക് തിരിച്ചു കൊടുക്കണം എന്നും ആവശ്യപ്പെട്ട് 200 -ൽ പരം വ്യക്തികളും സംഘടനകളും ചേർന്ന് ഒപ്പ് വെച്ച സംഘടിത പരാതി മുഖ്യമന്ത്രിക്ക് നൽകി. സ്വാമി അഗ്നിവേശ്, മേധാപട്കർ, കാഞ്ച ഇലയ്യ, തീസ്റ്റ സെതൽവാദ്, അരുണാ റോയ്, ആനന്ദ് പട്വര്ദ്ധന് തുടങ്ങി ഇരുനൂറിലധികം വ്യക്തികളും പ്രമുഖ സംഘടനകളുമാണ് സംഘടിത പരാതിയിൽ ഒപ്പു വെച്ചിരിക്കുന്നത്.
“2018 സെപ്റ്റംബർ 28 ലെ ചരിത്ര പരമായ സുപ്രീം കോടതി വിധിയെ തുടർന്ന് ബിന്ദുവും കനകദുർഗയും ജനുവരി 2 ന് ശബരിമലയിൽ പ്രവേശിച്ചു കൊണ്ട് ചരിത്രം നിർമിച്ചു. എന്നാൽ സ്ത്രീ പ്രവേശനത്തെ തുടർന്ന് മേൽ ശാന്തി ശുദ്ധിക്രിയ നടത്തിയത് മൂലം ഇന്ത്യയുടെ ചരിത്രത്തിൽ ഇതേ ദിവസം ഇരുണ്ട ദിവസമായി മാറിയിരിക്കുന്നു. പത്തിനും അൻപതിനും ഇടയിൽ പ്രായമുള്ള സ്ത്രീകൾക്ക് ശബരിമല അയ്യപ്പ ക്ഷേത്രത്തിൽ വിലക്ക് ഏർപ്പെടുത്തുന്നത് തൊട്ടുകൂടായ്മയുടെ വകഭേദമാണെന്ന് ജസ്റ്റിസ്: ഡി വൈ ചന്ദ്രചൂഡ് ചരിത്രപരമായ വിധിയിൽ നിരീക്ഷിക്കുന്നു. ‘മതത്തിന് സ്ത്രീയുടെ ആരാധനാ സ്വാതന്ത്ര്യം നിഷേധിക്കാനാകില്ല’ അദ്ദേഹം പറയുന്നു.
ശബരിമലയിൽ ശുദ്ധിക്രിയ ആചരിച്ചത് സുപ്രീം കോടതി വിധിയുടെ ലംഘനമാണെന്നും ഭരണഘടനാ വിരുദ്ധമാണെന്നും വ്യക്തമാണ്. അതുകൊണ്ട് തന്ത്രിയെയും മേൽശാന്തിയേയും ആ സ്ഥാനത്തു നിന്ന് നീക്കണമെന്നും, ഇന്നും ബ്രാഹ്മണിക്കൽ മൂല്യങ്ങളിൽ ഉറച്ചു നിന്നു കൊണ്ട് ഈ ശുദ്ധിക്രിയ നടത്തിയത് ഭരണഘടനാ മൂല്യങ്ങൾക്കെതിരാകയാൽ അവർക്കെതിരെ നിയമനടപടി കൈക്കൊള്ളണമെന്നും ഞങ്ങൾ ആവശ്യപ്പെടുന്നു. മാത്രമല്ല ഇരുപതാം നൂറ്റാണ്ടിന്റെ തുടക്കത്തിൽ ശബരിമലയിൽ ബ്രാഹ്മണർ ആധിപത്യം സ്ഥാപിക്കുന്നതിനു മുൻപ് ആചാരപരമായ അവകാശങ്ങൾ ഉണ്ടായിരുന്ന ആദിവാസി വിഭവങ്ങൾക്ക് അവകാശം തിരികെ കൊടുക്കണം എന്നും ഞങ്ങൾ ആവശ്യപ്പെടുന്നു.” മുഖ്യമന്ത്രിക്ക് സമർപ്പിച്ച സംഘടിത പരാതിയിൽ പറയുന്നു. പരാതിയുടെ ഓരോ കോപ്പിവീതം രാഷ്ട്ര പതിക്കും, ചീഫ് ജസ്റ്റിസിനും, കേരള ഗവർണർക്കും സമർപ്പിച്ചു. പരാതിയുടെ പൂർണ രൂപം താഴെ.

Over 200 women’s activists, dalit activists, adivasi activists, human rights groups, social organisations, cultural personalities and well known citizens demand the dismissal of the priests in Sabarimala over violation of constitutional rights and return the shrine to adivasis.
Sir,
Adv. Bindu and Kanakadurga made history on January 2, 2019 by entering the Sabarimala temple , a right accorded to them, by the historic Supreme Court verdict given on 28 September 2018. This day will also go down as a dark day in the history of India when the Tantris and Melshanthi (headpriest) of the Sabarimala temple conducted a ‘purifying puja’.
In the historic judgment Justice D.Y Chandrachud observed that the practice to ban entry to women between the ages of ten and fifty at the Ayyappa temple at Sabarimala is “a form of untouchability”. He observed “Religion cannot be cover to deny women the right to worship……To treat women as children of a lesser God is to blink at constitutional morality.” Justice Chandrachud also said that “exclusion of women is a violation of right to liberty, dignity and equality….. Exclusion of women because she menstruates is utterly unconstitutional.”
Article 17 of Constitution of India says that “Untouchability is abolished and its practice in any form is forbidden. The enforcement of any disability arising out of Untouchability shall be an offence punishable in accordance with law.” Article 17 of Constitution of India is the only Absolute right of the Indian constitution. The purification ceremony carried out by the Tantri in Sabarimala is a clearly criminal act as it stands in violation of Article 17, which confers an absolute right to all Indian citizens against the practice of untouchability, without exceptions or relaxations. No Indian citizen as per the Indian Constitution can be declared impure' or
untouchable’.’ It is clear that the purification ceremony performed at Sabarimala is unconstitutional and violates the Supreme Court judgment. Therefore we demand that the Tantris and Melashanthi of Sabarimala should be dismissed from their position and must be prosecuted as their action is against constitutional morality
Since this purification ceremony happened according to the values of Brahmanical patriarchy, we also demand that the Brahmin Tantris should be debarred from their hereditary rights over Sabarimala temple and the worship rights at Sabarimala be given back to Adivasis who were the customary custodians of Sabarimala until the Brahmins took control of the Sabarimala temple in the early 20th Century. We also demand that the Tantri status should be abolished and the Melshanthi should be reinstated to the Adivasis.
We appeal to make necessary steps to enforce community rights, resource rights and facilitate environmental protection of the forests around Sabarimala as well as Pampa river as per the Forest Rights Act.
